Probate is a court proceeding in which the validity of a decedent’s Last Will and Testament is determined and a “Personal Representative” is appointed pursuant to the Will. If there is no Will, the proceeding is called Administration, and the agent appointed to administer the estate is also called the Personal Representative. As a part of Administration, a petition can also be made for an order to determine who are the heirs of the decedent. Probate or administration is necessary for transferring assets after a person dies unless an exception applies or a trust is properly funded with the person’s assets prior to death. A main exception to the need for Probate or Administration include estates that had less than $100,000 in value of assets that do not include any real estate. Probate is a complicated process that should include the services of an attorney.
